Legal Question in Criminal Law in Florida
A friend of mine in Florida recently discovered a gift card, the other day. No one claimed it so she used about 4 dollars of it. The next day, the owner of the card shows up, and threatens to sue my friend for theft and for the money spent on the card. My friend offered to pay the lady the used amount plus interest. The woman is still threatening legal action. My friend quit her job due to embarassment and is currently in the Navy and is scared this will get her discharged. What is the best path forward for my friend? Thanks!

Depending on all the circumstances, it sounds if she found abandoned property. Since she had no knowledge who it may have belonged to, she has offered to do what she can. If she gets sued for the $4, then that's all the other party will get is $4 so they best take it and run. Now if your friend knew whose it was, then it certainly becomes criminal and she should contact an attorney immediately. Regardless, it's a good idea for your attorney to talk to a friend anyway.
