Legal Question in Criminal Law in Florida
A friend of mine has been wrongfully convicted of child molestation and there are at least 3 people who know the truth about the situation. In this case, what can be done in order to have the conviction overturned and the ones who know about it be made to tell the truth about what they know? How do you go about clearing your name when something of this magnitude has happened and you were railroaded in an unjust court case? What procedure do you follow? What recourse do you have to clear your name and have it removed from your permanent records? Will the person who did the wrongful accusing have to be accountable for it? What punishment would happen to them? Will there be jail time or loss of minor children still involved? What is first step to take to prove their innocence?

If your friend has been convicted, then his only recourse is to appeal. After going through the appellate process and succeeding, he can then take steps to prove his innocence. Talk to his attorney or hire one immediately to handle the appeal.
