This depends on how many times the card was used in a 6 month period or how much was fraudulently obtained. In one case, this is a first degree misdemeanor, punishable by up 1 year in jail and and a $1,000 fine. In the other situation, this is a third degree felony, punishable by up to 5 years in prison and a $5,000 fine.
