Legal Question in Criminal Law in Florida

Gary and Nigel used to be very good friends but then had a terrible row over a girlfriend and had been enemies ever since. One night they saw each other across a crowded pub and Gary raised his fist, shouting across to Nigel �If we weren�t surrounded by people I�d make you suffer�. Nigel came over to him and caught hold of his wrist, saying, �Don�t worry � I�ll give you a chance later � I�m going to get you after the pub closes�. Gary was worried when he heard this as he knew that Nigel had most of his friends with him.

When the pub had closed Gary set off for home but as he was walking down a dark, country lane, Nigel jumped at him from behind and struck him with a heavy branch he had found nearby. Gary lay in the road, bleeding heavily and unconscious. Nigel panicked and ran away, leaving him there. Gary was later hit by a passing car, the driver of which was unable to see him as Gary was wearing dark clothing and the lights on the road were broken. Gary was killed instantly.

Discuss any criminal liability which arises.

This sounds an awful lot like a question from a course on criminal law/business law. If so asking for help here is a breach of the ethics code of your school. Call it cheating if you will.
