after arrest how long does the state have to file charges before it has to be dropped.

If a first time arrest as long as you don't get adjudicated guilty, you can have it sealed later or expunged if the charges are dropped.

The statute of limitations for a third degree felony is 3 years. The state has 3 years from the date of the offense to file charges.

They have 33 days from the date of arrest to file and be able to continue to hold a defendant in jail.
