grand theft auto

i rented a car from enterprise and had it for a month, they reported the car stolen and i didn't know until i was stopped and arrested. for grand theft auto then out on bail. my property is still in the car but they don't want to give to me unless i pay what should i do i have a pending case in court because of them?

First and foremost you need to resolve your criminal case before you get too worried about what's in the car.

Any communication that you have with enterprise could be an admission and possibly used against you in the criminal case. Also you don't want to piss someone off over at enterprise who makes sure they are at every hearing telling the prosecutor that they want the maximum punishment in your case.

At this point I would not pay enterprise a dime until you have spoken to an attorney who is able to work something out with the state in return for a favorable sentence.

I was prosecutor here in broward and prosecuted a few of these failure to return rental car cases and always had a hard time tracking down the right person at the rental car company who was able to testify against the defendant.

For that and a few other reasons you may have a winable case.

Overall there are several issues which may have bearing on your case, such as when did you rent the vehicle, did you pay cash or use a creit card, and what communication you had with the rental company during the contracted period of the rental - such as did you at any point communicate with the company and ask for an extension.

Overall, i would not advise you to have any communication with the rental company, and would advise you to seek an attorney immediately.
