Not Guilty with Arrest Record

My 19 year old son was arrested on a misdemeanor drug charge (the butt of a ''joint'' supposedly found during a voluntary search- no warrant). He pleaded not guilty, paid a court fee, and was told that it wasn't a conviction but that it would remain as an arrest. What happened to ''guilty'' or ''not guilty'' and a clean slate?

I don't know exactly what happened from your question. It sounds like some sort of pre-trial diversion. The arrest record remains unless he is elibible to have the record expunged.

Being found not guilty doesn't change the fact that he was arrested. An arrest proves only that the arresting officers considered him a suspect and is not nearly equivalent to a conviction.

he will have to show actual innocence to get the arrest expunged unless state law allows it.
