I have a gun charge on my record from 11 years ago,I was 17 years old and tried as an adult, breaking and entering and I had a gun with a full clip..I haven't been in trouble since then,.needless to say I am not allowed to own a gun,can I get this expunged so I can purchase a gun legally again?and if so how do I go about doing it?how much will it cost?and how long will it take until I can get one?

Re: gun charge expungment?

Hello: I just read your question. The main thing you should know about the Fla. Statute on this issue is one can only seal a prior criminal record if he/she was NOT ADJUDICATED GUILTY of the charge OR OF ANY OTHER CHARGES in another case. Adjudication of guilt is a finding by the court at sentencing and would be written in the court file. If the court withheld adjudication of guilt, this is NOT a conviction and could be sealed so long as you never had any adjudications of guilt (convictions).

These cases are not that expensive for attorneys to handle (probably around $350.00). If my office can be of any assistance to you on this, let me know. Good luck, Tom Rosenblum

Re: gun charge expungment?

If you were adjudicated you cannot seal or expunge. If you have a withhold of adjudication it takes about 6 months and I charge 1500.00 all inclusive. Please call if I can help.
