Held in Jail
A juvenile who was 17 yrs. old at time of arrest has served tim for the crime charged. But now is being held in jail to be a witness for a crimethat happened in 2004. The defendant in the case was just caught and the pre trial hearing is late October. What recourse does he to get out before then?

Re: Held in Jail
if his original sentence is complete, there is no justificatoin for them to hold him in jail simply to be a witness. Now, lets say he was a co-defendant on that 2004 case, and took a plea where he would testify, he could be serving his time on that charge, albeit a lesser sentence because of his promise to testify. I really need more facts before I could give a more definite answer. However, an attorney could always file the proper writ to get the person released where the facts make it possible.
