Legal Question in Criminal Law in Florida

I've hired a criminal attorney to represent my son, I paid 25,000 dollars. A year has passed, we have not been to court for anything. No depositions, no investigator, no nothing as far as I can tell. When he took my first 15,000, he assured me he would have complete resolution in a year. When he is asked I'm told everything is fine and the prosecutor knows nothing of this case. what are my options for firing this attorney and getting my money back if the only thing he has invested in defending this case is getting copies of the discovery packages and a couple visited to my son in jail?

I'm sorry you are having this issue. First and foremost, it is always difficult to predict the timing and result of a case and it is unethical for an attorney to promise any sort of results in a criminal matter. Your ability to receive a refund on your fees will depend on your contract. If you feel that the particular attorney has somehow cheated you, you should bring up the issue with him or her first and if you are not able to resolve it, the Florida Bar has a hotline that helps clients and attorneys resolve problems. This service is offered free of charge.

If you are not satisfied with your current lawyer's performance, however, it may be in your son's best interest to obtain a second opinion on the case. My office offers free consultations in criminal matters.

Good luck,

Mario Musil
