Legal Question in Criminal Law in Florida
Home invasion
My boyfriend is charged with home invasion, the victim is not showing up in court at all but the co-defendant has agreed to testify against my boyfriend. Can he be found guilty without a victim??

Re: Home invasion
He can be found guilty without the victim, but it is very unlikely with just the statement of the co-defendant. The prosecution must prove beyond a reasonable doubt that your boyfriend was not authorized to enter the premises, and usually only the owner of the premises can establish that. However, there are times when that can be established by what is called circumstantial evidence.
