Legal Question in Criminal Law in Florida
Help Me...
my husband is up on three felony charges. This is his first time being in trouble with the law. The charges are indecent exposure, lewd and lascivious battery with a minor 16, and tampering with a witness. He has a public defender and she said that the state doesn't have enough evidence to convict, so they keep pushing back his court dates...''what should I do?'' Should i get him an Attorney?

He has an attorney. Public Defender's do nothing but represent clients in criminal cases. Whether you use the P.D. or hire a private attorney, is your and his decision. Just make sure he has an attorney for something this important. The only negative comment I can make about P.D.s would be that they are often very busy with large case loads. Thus, I hear from some clients they don't always return phone calls very quickly. Additionally, a younger attorney may not have enough experience to properly handle serious cases. As you may be aware, a private attorney would need a retainer to handle this type of case. 'Hope this helps. Tom Rosenblum

I would strongly recomend you get another lawyers opinion if you can afford it. These charges are very serious and will put him in prison given todays harshness on sexual based offenses.(mark foley,etc).
