Legal Question in Criminal Law in Florida
My husband was in Florida on Parole Under the Interstate Compact from Alabama. On Apr 2 he was arrested and charged with loitering/prowling (a 2nd degree misdemeanor...punishable if found guilty of 60 days in jail and up to a $500.00fine). This violated his parole. Prior to this he has never had a single problem while on parole in Florida. He is 6 months away from earning a college degree. Today he pled no contest and got time served and a $50.00 fine (he went to court in Florida). The judge withheld adjudication. How long does Alabama have to notify Florida if their intent is to come and extradite him (he waived extradition on May 1st) and how long do they have to actually come and get him?
1 Answer from Attorneys
They can choose to extradite him at any time while he is on parole.
