Legal Question in Criminal Law in Florida
my husband
my husband has been in jail for about 6 months now. He went to court back in august and the DA offered him 20 months and he didn't take the time.when he went to court the second time they offered him 8 yrs. the third time he went they offered him 30 months doc. hid next court date is jan 8th. what is going on? why can't the da and his public defender come up with a deal? is his public defender really working for him or what? will the judge eventually get upset and just sentence him to whatever he wants to? i don't know what to do!!! HELP!!!!

I'd be very careful. Offers can come and go on the mood of the prosecutor. If he can't beat his case, he should probably jump on the best deal he has. Unfortunately, some people think the longer they wait, the better the offer. That is usually not the case. Be very careful. I had a client whose original offer was 21 months. He ended up with 15 years when he kept changing his mind.
Also, no, the judge will not just get frustrated and sentence him.

Offers usually go up as time goes on. Eventually the judge will set a vop final hearing and then sentence him if he loses.
