Legal Question in Criminal Law in Florida
husband has leaving scene of accident with injury case going. the person had a knee injury and was seen jumping around 2 weeks later fine. now they are stating back and shoulder issues. victim states restitution should be 10k. they do not want probation and restitution and want jail time. is that up to the victim or can the state make a deal. there were talks about probation and all of a sudden not due to them not wanting restitution. is all this possible. he does have an attorney that we hired and she is stating that he will get jail time now like there is no other way around it. he is willing to do restitution and extend the probation (he scores to 18 months probation). what can be done? judge today stated that he needs official restitution amount and proof in a month if not it will go to civil. After court this is when the state told the attorney that the victim wants jail time. need help asap. don't have a lot of money but can do a payment plan. looking for help since this does not seem right 7272267228

Mr. Trabin gave good advice before. Your husband needs to talk to his attorney about the best way to challenge the amounts. You can hire an attorney if they are willing to do a payment plan, but it is unlikely since it appears that restitution is not able to be paid either. Doesn't mean you shouldn't try, but just pointing out the obvious to you.
