Legal Question in Criminal Law in Florida
My husband has been on probation for 5 years that end this December, for unemployment compensation, hi has to go to court this week because out of all the task he has done the one thing he did not complete was paying all the restitution, he owes about $800.00 still, this is because in all this years we had hard times every time I was employed he was not and when he was employed I was not, we are finally both at good jobs since August of this year. Will he go to jail for not paying the money by the end of the 5 years? Please Help

It is certainly possible. However, he will be asked the reasons he hasn't paid other than "hard times". Has he tried community service for the other costs? Has he asked probation to waive their costs so that restitution gets paid first? Does he have assets that he could sell? In order to avoid the possibility of prison, the best thing to do NOW is to gather up as much as possible and pay it. Meanwhile, if the probation office officially violates you, make sure to get him a public defender as soon as possible.
