Legal Question in Criminal Law in Florida
My husband has been sentenced to 39 moths in prison for violating probation with a dirty urine. He was tested 7/17 and was positive with his levels being at 949ng. He was reinstated on community control and then was tested again on 8/17 still being positive at 28ng. My husband has not smoked since his last VOP and I don't think it is fair what the judge sentenced him to. I have never seen anything like this. We had a drug testing specialist come in and testify at the final VOP hearing and the judge said the still didn't believe that my husband didn't use. My husband is now facing removal proceedings with ICE one he is released.

Since it sounds like he exercised his rights to a hearing, then he can only do two things: Appeal, and get an immigration attorney.
