Husbands request for evidenary hearing request denied, what is the next step

It's not clear what you are asking. It certainly depends what kind of evidentiary hearing this would be. For example, a motion to suppress requires an evidentiary hearing unless the motion is legally insufficient. So if that were the case here, the attorney would have to redraft the motion to suppress to ensure its sufficiency. Then the court would be required to have a hearing.
But it really depends what kind of evidentiary hearing was being requested and why it was denied.
