Legal Question in Criminal Law in Florida
identity theft
If a person used someone elses identity info to obtain a credit card and was given a card, used it to the amount on $10,000.00 but is making payments, what is the person facing? If this person has no criminal record and has been a productive member of society, would the person be allowed to make restitution without prison time? Also would the person be under the state law of the victim or the state where the theft took place?

You can avoid jail if this is your first offense of this kind, and also if you pay down the balance significantly.
