Legal Question in Criminal Law in Florida

identity theft

My son and I were in miami from december 28th thru the 31st. His birth certificate was stolen from Our room on our last day there. We were unable to wait and file a police report before leaving because we were pressed for time to catch our plane. We were assured that the police report would be filed for us thru the hotel. I contacted the hotel one week after our return to new york and was told that no information can be found regarding the theft and that there is no indication that a report was ever filed. What legal action can I take? can I file a report from new york? can any legal action be taken against the hotel?

Just contact the Miami-Dade sheriif's office and ask to file a report.

You should call the miami dade police department and file report. You say this is identity theft but from the facts all i see is either a missing or stolen document unless you have left something out like they got a driver's license or credit card in his name. Has identity really been stolen yet, or just a document pertaining to his identity. There is never a legal action unless you can prove negligence and actual damages, so unless you suffered a loss, other than peace of mind, there is no action. Hopefully nothing has, or ever will, actually happen.
