Is it illegal for an hiv infected person to have unprotected sex without telling the uninfected person about their status

Yes it can be considered a third degree felony punishable by up to 5 years prison. The only real defense is that the other person knew and proceeded anyway, which often happens with married couples and other serious relationships.
