Illegal Immigrant To Testify in court
Illegal Immigrant is subpoena'd to testify on behalf of a victim in a mideamenor battery case. Are they in danger of being deported if they show up and testify? When giving a deposition to the lawyers of the guy being accused the 1st thing they asked was if he was illegal.. He said: Yes. Is that like a scare tactic? The victim does not want to get their friend in trouble or deported or in the system to be deported in the future. Any help?

It is not likely that the illegal person has anything to worry about. They won't be arrested in court.
Of course, anything is always possible as far as dealing with an illegal is concerned. But, I have never seen someone detained in court for testifying as a state witness because they were in illegal.
In fact, many illegals are arrested for not having a valid driver's license and are allowed to post bond to get out of jail. They then return to court on a future date to resolve their case and they are not arrested then.
So, not a likely problem at all...and yes, likely a scare tactic.
