is it illegal to leave state if you are under investagation

I don't think so. If you have not been arrested or bonded out, you may come and go as you please. However, if under investigation, I would certainly contact the detective(s) working the case to let them know where I was going, how I may be reached, and when I will be back. One should avoid the appearance of any impropriety - i.e. flight or evasion. In my opinion, this is one of the exceptions to the general rule of "don't talk to cops."
