is it illegal to send nude photos over the cellphone to someone who asks for one, knowing this person is NOT underage

If the recipient is not a minor and the nude person is not a minor and is not engaged in any sexual act and the recipient requested the photograph, I do not believe it would qualify as obscene material within the meaning of FS 847.011
