Legal Question in Criminal Law in Florida
improper arrest
i was arrested on 1-27-01,for misdemenor possesion of cannabis less than 20 grams.the charge was subsequently nolle prosequi by the state attorney after completing a pre- trial intervention program on 7-25-01.i recently recieved my arrest packet ,containing the charging affidavit,narrative report,incident report,& victim/wittness form, the victim being the state of fl.in my arrest packet there is nothing to corroborate the charge,i.e.no testing of the evidence seized.the reports all label the evidence as ''suspect cannabis''.what recourse do i have,if any,especially being that nothing was done to identify this ''suspect cannabis'' as real cannabis or marijuana,validating the states charge of possesion?

The charges against you have been dismissed. I am quite certain that you dont want to go back into the criminal justice system. If you are alluding to bringing a law suit to obtain damages, I doubt any reputable attorney would take it. I do suggest that you proceed in having your records sealed.
