Legal Question in Criminal Law in Florida

Inaccurate Police Records

I recently volunteered as a shaperone on an elementary school trip for my daughters 6th grade field trip. I was rejected by the board after a back ground check revealed I was arrested and convicted of a felony assault charge in Florida. I have only been arrested once in my entire life for DUI and it was dismissed. I have no felonies and no prior arrest. Can I demand a records check from the sheriff's office and get it cleared or do I need an attorney and find out who and what is on my criminal record?

Re: Inaccurate Police Records

The school board is permitted to deny chaperone status, even if you haven't been convicted. It may not be fair, but it's the rule in many counties. You'll need to have your arrest sealed to be a chaperone.

Re: Inaccurate Police Records

I've found that school boards are primarily interested in covering their bases, and will initially deny any potential shaparone with any questionable history. Their research showed a felony dui arrest, which presents a risk to the school board if they allow you to monitor children, let alone, drive. I've found that if you give them a reason to question their research, they may reconsider. If you obtain the court records showing that the case was dismissed, and deliver those records with a written request to be reconsidered, they may change their position.
