Legal Question in Criminal Law in Florida

incarcerated on VOP
my husband was incarcerated on vop 1/1/2008.In 1999 went to prison for 2 yrs on burglery.Was told he had probation until2010.In 2005 he wrote 3 checks on my checking account and the prosecutor picked up and charged him with a felony because of probation.On 1/1/2008 he vop we found out that in 2002 his probation was unsucessfully terminated but we were not told about it.I spoke to an attorney locally and he said this changes everything.My husband is serving 27.7 months in prison.For$3500.00 this attorney could get my husband out.Because he was not on probation at the of writing the checks they would have been misterminors and prison time would not have been in play.We have filed a 3.80 andthe prosecutor has agreed about the probation but we have been waiting 60 days for judge to sigh off.We also dont know if it is a possibility for my husband to be free,He served 3 years probation,paid fines and fees with no problems.That should count for something.This happened in BayCounty,Fl. Please help anyway possible.Thank You

I am not sure what your question is. I dont believe attorneys who promise results, because You just can't predict.
