Legal Question in Criminal Law in Florida

inmate needs medical attention

My fiance is in jail for a VOP on a perscription fraud charge. His VOP is for not reporting to the probation officer. He was unable to report due to an injury. A few months after the charge he was hit by a car, causing brain damage, which he had surgery for, and a broke back. His medicine kept him in bed for days at a time. He has been in jail for the VOP for 4 mths. The judge has been informed of the injury and refuses to release him. He has had an evaluation for his memory but it has not proven him incompitent. He is waiting to have a second eval done, which was requested over 2 weeks ago. Basically he was suppose to be following up with doctors for evaluations for his brain and back, but is unable as he is in jail. It is imperative that he sees these doctors to try and prevent permanent damage. Even if on a home moniter he would be able to do so. How long can the judge keep him in jail?, or is there any advise on how to get him out.

Re: inmate needs medical attention

It sounds like your husband has an attorney already. Because of that I cannot advise him of what to do. If he are represented by another attorney or public defender then you need to ask them. All those things you told me should be told to his attorney. Medical records are a must - if you have not gotten copies of those records, get them! Give them to his attorney.

If he is not represented then call.
