Legal Question in Criminal Law in Florida
What are the interview laws for interviewing children in the state of Florida?
1 Answer from Attorneys
A child has the same rights as an adult under the Constitution with certain extra protections. If you are the parent you need to get an experienced criminal attorney who handles juvenile cases.
If you are speaking about a child being interviewed as a witness - you need to have the court protect the rights of the accused and the child. In some cases, where there is sexual abuse suspected, the judge will actually watch the interview which is conducted by a licensed mental health counselor ( only use a child psychologist or forensic child psychiatrist) or a speech-language pathologist with experience in interviewing children and holding the Certificate of Clinical Competency from the American Speech-Language Hearing Association.
