Could I Go To Jail For Statutory Rape?

Yesterday a cop pulled out on me, a friend, and a girl from our neighborhood that claimed she was 16. The cop told everybody to sit down and my friend ran. I had a condom in my pocket and a blue bandanna, and the cop said he could arrest me for interference of parental custody because apparently the girls foster mom didn't want any of the foster kids around me. It also turned out that the girl lied about her age she was 13. The cop also found a letter in her purse detailing sexually explicit things. The cop said if I co-operated he wouldn't take me to jail. So I thought of a fake name for the friend that ran away. Later on that day the cop found my friend and found out I gave him a fake name. Then this morning the cop comes to my house and asks to speak with my parents they weren't there so he waited till they came home. When they got home he proceeded to tell them that he was going to file statutory rape charges on me and that he was going to place an arrest warrent on me. I never did anything sexual with the girl like the cop claims even the girl said I hadn't done anything. Is it possible the cop was just trying to scare me? And if there's so much evidence why didn't he arrest me when he came to my house? I'm 18 by the way.

I think if they can find any evidence of sexual contact they will charge you. If she has been examined by a doctor, they may be looking for semen or dna before they make an arrest. The cop has better things to do than scare you.

It may be that the cop had the girl tested to see if there was evidence that the two of you had sex, and he was waiting for the results. That may be why he didn't arrest you on the stop. If so, though, why did he come to your house? Was he expecting a confession or was he just there to harass you for giving a false name on your friend? I suspect the latter.

Also, based on what you've said, he completely misunderstands the charge of interference with custody.

Only you know for sure what you did with the girl, and, of course you don't know what she told the cop, but what you say sounds true, so I think you may be correct in that he was trying to scare you, probably to keep you away from the girl in the future.
