Legal Question in Criminal Law in Florida
Job Application
Many job applications ask two questions. Have you accepted a disposition of adjudication withheld on any criminal charge? Have you ever been convicted of a criminal offense, pleaded no contest to charges or agreed to enter in a pre-trial diversion or similar program in lieu of a criminal prosecution for any crime other than a minor traffic violation? I have a DUI charge on my record. What would be my answer to these questions?

Since all Florida DUI convictions result in adjudication, the answer to the adjudication withheld question is no (unless there is something else on your record you didn't mention). The answer to the "convicted of a criminal offense" question is yes. I don't know if you pleaded no contest, guilty, or were convicted at trial on the DUI, so I don't know how to tell you how to answer the third question. A DUI, by the way, is not considered a "minor traffic violation," it is considered a criminal offense.
