Legal Question in Criminal Law in Florida
if a judge wants to take a person back to court on the same charge and don't have any new evidence can the state attorney do that . take him or her back to court and re sentence him or her .

I would need a lot more information to answer. It could be double jeopardy, but it could also be a VOP or some other legal scenario. I suggest you hire an attorney in your area to see if they can do that in your situation.
