Legal Question in Criminal Law in Florida
If my keys were held from me inside a persons home and they would not return them to me and taunted me from the the window for 45min, what would be the best defense for hitting the door too hard while trying to retrieve my property and the door opening off the hinges, and receiving a criminal mischeif charge (still not entering the home) even though im the one who called the police for help after another 45 min of pleading with the other person to just give me my keys back. Also when the police showed up the arresting office only got the statement of the other person then handcuffed me reads me my rights, adding another charge of simple assault/ threat to do violence because the other person and him made up some story, i feel like i was not given a chance at all they looked at me, looked at her, saw the door, and decided to just go with whatever story she wanted to say even tho she was obviously under the influence of pills and alcohol, i really feel like my right were violated so i was wondering if they were?

You have the right to take "reasonable" steps in defense of your property. It may be for a jury to decide what is reasonable though. The best thing to do is to get an attorney to fight for your rights.
