what is the penalty for a first offense larceny charge of over $300 but under $5000

The penalty could vary depending on a variety of things.
Some judges are tougher than others.. Same goes for prosecutors. Also, it would depend on the facts of the case, including
what the victim wants to see happen.
Under the sentencing guidelines you would not score any manditory prison, as this is a first offense.
However it is a third degree felony and you are potentially looking at 5 years in prison on the upper end.
Not to mention what a felony does to your record. Can't vote, own a gun etc.
