Re: leaving the state while on probation
NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
The court will be aware of your record when the domestic battery case is called up for hearing. If you fail to appear, they will almost certainly notify your probation officer if they have not already done so who will violate you and order a pickup. While the State will probably not actively send someone to look for you, the odds are that you will be either stopped for a traffic violation or be arrested for something else in the future and then there will be warrants out for your arrest in Florida in the system. You will be held in New York (or whatever state you happen to be in) without bond until extradition hearings can be held. This is not a smart way to handle matters. You should hire a good criminal attorney to resolve your issues before leaving and not have this hanging over your head.
