Legal Question in Criminal Law in Florida
Is it legal to charge an individual with grand theft of a motor vehicle and attempt to defraud? If there was a contract between the two parties. The individual buying decided he didn't want the vehicle because of mechanical problems so he returned the vehical voluntarily and put stop payment on the check a few weeks after the contract was made. Three weeks later a report was filed by the seller of the vehicle to the police. The buyer of the vehicle was later arrested for grand theft of a motor vehicle and attempt to defraud.

It is possible so long as there was an INTENT to defraud and/or steal. It sounds more like a contract dispute but it is certainly possible.
