Legal Question in Criminal Law in Florida
legal question
I live in Florida and I have a friend who has a 11 year old daughter and the father calls and cusses at the little girl. If the daughter is on her cell phone with the speaker on and the father is on his cell phone can I record the conversation with a hand held cassette recorder.

Re: legal question
It's a felony in Florida to record phone calls unless both parties to the call are aware they are being recorded. Also, the tape of the call can't be used as evidence unless both parties to the call are aware they are being taped.
Of course, you can gather a bunch of people around the speaker to go to court and say it happened.
