Legal Question in Criminal Law in Florida

letter of pardon

I was aressted in 2005 for grand theft in attempt to use another persons cc and fake id! It was my first offense ever, seved my two years of probation and been good since then. However it was a phelony conviction and I do realize I am unable to get it sealed or expunged, I've already gotten my civil rights restored but would like to request a letter of pardon from the governor in attempt to have this situation not hinder me in the future....

what are my options and the best way to go about it?

Re: letter of pardon

What you are requesting is help in applying for Executive Clemency. I'm surprised you were "convicted" of those charges if they were your first offenses. Most first time offenders, on theft charges, will get a withhold of adjudication and probation. Obviously, an experienced attorney would need to look at the Judgment and Sentence from that case.

If you have any questions about Executive Clemency, feel free to contact my office and I can answer any questions that you may have.

My best,

Aaron J. Slavin, Esq.

Re: letter of pardon

You are correct that if you were actually convicted, you would not be eligible to seal or expunge your record. However, it may be a withhold, rather than a conviction. If so, you may be able to seal it.

Otherwise, you can contact the Governor's Office of Executive Clemency. That office exists just for this type of situation.

An experienced attorney can help you through this process. Please feel free to contact me if you would like to discuss this further.
