Legal Question in Criminal Law in Florida
Level of misdemeanor
I am 54 years old and in 1976 I had one charge of Petty Larceny for a $13.00 pair of pants. According to the judge it was to be expunged. I saw the record it was not. I have said I have no record until now when I find the disp was ''conv''. The question is. I am now to have a background check and report any felonies or misdemeanors of the first degree. Would this come up? I have said I have no record for I thought this to be petty.
What classification is this misdemanor and what does this fall under once backround check is established.

You cannot seal or expunge a conviction. I would hire a lawyer to make sure you are reading the disposition correctly and to investigate sealing. Petit theft is a second degree misdemeanor now, but I dont know the level i 1976. Contact a lawyer to advise you.
