lewd and lascivious act
If a person 18+ is convicted of a l/l act with a 12-16 year old, it is felony in second degree and that person gets a prison term, according to Florida state law. But if the person only gets 5 years probation for this is it still considered a felony or is it not a felony?

If one is adjudicated guilty of a felony its a felony. The sentence doesn't matter. A conviction sounds like an adjudication which is a felony.
