Legal Question in Criminal Law in Florida

we live at current residence for 3 years. during 2 years our neighbor would say i dont like you i can beat you up and kill you to my husband just out of the blue then he would complain of noises we make at 1am through 6am which we are asleep. my husband always tell him we are sleeping what do you hear, then he would make threats again. in 2009 our neighbor was arrested for 40 marijuana plants and 11/2009 got unsupervised probation he came home. this year we found out from his mother he is paranoid schizophrenia and she told us he wants me my husband my 2 children and my mother dead. we call police they told us he admitts it they will take him to jail and baker act him. according to his probation he is not have drugs they found one marijuana plant now he is in jail. question is since he violated his probation how long does he get? what can we do protect ourselves from him? because he wants us dead, come 9/5/12 which is his hearing we think he will get out. the charges for 40 plants was count 1 purchase or possession of contollred substance with intent to sell and count 2 use or possess with intent to use drug parahernalia

Unless he is posing an IMMEDIATE threat, there is probably little you can do. If he attempts to get violent, then you should call the police. In the meantime, if there has been at least two instances of violence towards you, then you could file for an injunction against him.
