Legal Question in Criminal Law in Florida
I live 11 hrs away from Florida. Have since before this mess. That being said, I had a Temp bs injunction for Protection placed on me by kids stepmom (she lied under oath) but only banning me from contact with her. She and my ex have kept the kids from having any contact with me but that is due to Parental Alienation. In the Court the judge believed her lies. So in the papers it states no contact by me or thru a 3rd party. My husband called her without me knowing, we were separated at the time. They put out a motion to make it permanent. So since I was not aware of this I did not go to court. Now a warrant has been placed on me within the state of Florida. I have had no contact period with anyone from my ex, his wife or my kids in 4-5 yrs. my question is how do I get this expunged in order to see my son graduate from Highschool. The statute charged with was 741.31.4A5 according to the warrant. Please forward me to anyone that can help in this matter. I just wanna see my son graduate. I have not seen hom at all in the last 7 yrs.

You are being charged with a first degree misdemeanor, meaning you face up to a year in jail. You need to contact an attorney that handles cases in the area that this arose from. Being out of state is not necessarily a defense, but do you need to hire local counsel. I suggest you go to FACDL.com and look for an attorney in that area to help you.
