Assuming due process has been followed as far as being properlyarraigned by the judge, then a person can sit in jail on just probable cause until the day they go to trial. In theory, they can NOT be found guilty on probable cause since the burden on the state is guilty beyond reasonable doubt. I say in theory because many people are convicted on less than probable cause.
