How long can you be held in jail if not charged

I WAS NOT SURE WITCH ON TO PUT FOR AREA OF LAW!SORRY!

Well a friend of mine is in jail.He has been in there since nov. 24 2008. It is now 01.07.2009.he has been in there 45 days tomarrow.thursday| He has not been charged by the state. The lawyer has not been in touch with him since dec.1. when he 1st spoke with him. Is he spost to be in jail this long?

If he has been in jail for longer than 40 days, he should be entitled to a release without a bond. However, you need to file a motion with the court for his release, and you need to do it before they file charges.
