Depends on what stage of the investigation they are at. If there has not been an arrest, then it is the statute of limitations, if any. If arrested, then they have the speedy trial period which is 90 days for a misdemeanor and 175 days for a felony. You need to talk to an attorney to see which situation applies to you.
