How long is the statute of limitations for a second degree misdemeanor? The incident that occurred: It happened in Florida and I hadn't gotten my driver's license yet and drove a couple times without a valid driver's license. I believe that is a second degree misdemeanor. I also did this same thing a few months ago except I wasn't sober but luckily I wasn't caught. I was 17 and recently turned 18 and I am just trying to figure out the statute of limitations so that I can be on the safer side till it ends.

It's one year for a second degree misdemeanor. However if you've been served the ticket than the statue of limitations is no longer relevant.
