Legal Question in Criminal Law in Florida

Lude and Luscivious behavior

my boyfriend had sex with a girl who told him and 2 others that she was of age(18) while he was intoxicated and at his brothers home. The next day, the police, the girl and her parents went to the home and he found that she was a 14 year old runaway who had lied about her age. he was arrested and charged with Lude and Luscivious behavior. His public defender wants him to plead guilty to a lesser charge of Child Abuse with 2 years probation and the treatment of a sexual predator. Does he have a better chance of fighting the case in court or should he take the lesser charge. His guilty plea statement does not include many of the promises i am told that were made to him, and states that '' No other agreements, representations, or promises have been made by myself, my attourney, the Court, or any representative of the state''. It also states that the full extent of the charges and case have been explained to him which he tells me have not. Should he trust what is going on or try to go to trial with the public defender as his defense lawyer?

Re: Lude and Luscivious behavior

I have defended a bunch of these cases. The problem is that they are unwinable. There is no defense. That she lied, that she looked older, that he checked her ID, that she cosented are all losing arguments. The best you can hope for is a good sentence. A second opinion is wise. I am available for consultation for a reasonable fee.
