Legal Question in Criminal Law in Florida
marijuana possession, misdeameanor
My son (19) was stopped by the police on his way home from a friends home. He was stopped because of a burned out license plate light on my car. (however, since I have two bulbs, the plate was still illuminated). He was subjected to a search, and my car was searched by dogs and by hand. They did find one small marijuana cigarette on him that was given to him by an aquaintence of his friend. He was not arrested, but given a notice to appear in court. He has no criminal history, not even a traffic incident and we have no experience what-so-ever with matters of this sort. He has a part-time job and goes to college full time. What can we expect as far as penality? Should we hire a lawyer. Our appearance date is next Wed. Could I hire a lawyer in such short notice?

Absolutely- you should contact a lawyer. It does not have to be our firm but you should meet with a lawyer. Possession of marajuana is a misdemeanor punishable by up to a year in jail. Not likely to get that his first time out. From what you described there may be a motion to suppress to be made. There are a few other options.
