Legal Question in Criminal Law in Florida

misdemeanor battery and the penalties for juvenile

I would like to know what are the penalties for juvenile misdemeanor battery that goes to trial and what happens if the defendant loses. The defendant is 17 years old and is my son, who is being accused of being involved in a fight at school with other students, but he denies any involvment, only that he was present at the incident and that he did not touch the child at all. I would like to know what will happen when we go to trial.

Re: misdemeanor battery and the penalties for juvenile

There are a variety of things that can happen. While not always fair, some judges penalize defendants that go to trial and lose. There is a judge in Palm Beach County that will sentence an individual to jail time on misdemeanor counts if they lose at trial even if they have no prior record.

It is important to check out the judge on the case as well as the facts.

Does your son have any witnesses that will testify for him at trial that he was not involved?

Did your son have any marks or injuries consistent with a fight?
