Legal Question in Criminal Law in Florida
Misdemeanor Battery (Statute of Limitations)
What is the statute of limitations for Misdemeanor Battery? When does that time start? For example, if an incident occurs on 03/03/07 but doesn't go to court until 07/19/07, which date does the statute of limitations start on - the date of the actual incident or the date the state picks up the charge? Thank You!

Re: Misdemeanor Battery (Statute of Limitations)
The Statute Starts to run when the event takes place, but the statute only runs until charges are filed. Once the charges are filed, then the statute is no longer in play. The statute of limitations only applies to the filing of charges. After charges are filed, then speedy trial issues come into play.
